On December 6, 1986, Jason Grieb was charged with two counts of burglary in the second degree and two counts of theft. Following a CrR 3.5 hearing, Mr. Griebs inculpatory statements to the police were suppressed because the State failed to show he understood his Miranda rights. Because of the suppression, the charge was dismissed for lack of evidence. The State appeals contending Mr. Grieb knowingly and voluntarily waived his rights prior to giving the statements. We affirm.
