Publisher Description
Barry Jay Smits (Smits) appeals his conviction for the assault of a police officer. His contentions are two-fold: (1) the trial court erred in disallowing cross examination of the police officer as to his potential financial interest from a (possible) civil suit against Smits, and (2) instructional error in that the trial court erred in instructing the jury with regard to the necessity of a person producing a driver's license when asked by a police officer. We reverse.
