RYAN, Circuit Judge. Petitioner Joni Zaitona appeals from the decision of the Board of Immigration Appeals which dismissed Zaitona's appeal of the immigration Judge's denial of his motion to terminate deportation proceedings. Zaitona contends that the Board erred in concluding he was deportable for having committed two crimes of moral turpitude. He argues that one conviction should not be considered because the sentencing court made a judicial recommendation against deportation, and that the remaining conviction should not be considered because it was not for a crime of moral turpitude.
