Publisher Description

MEMORANDUM* Dermelle Dwayne Davenport appeals his sentence imposed following his guilty plea to possession of cocaine base with the intent to distribute. We dismiss. Davenport challenges the extent of the district court's downward departure from the career offender guidelines. Specifically, he contends that the district court's downward departure from his criminal history category was ""based upon its premise that [his] robbery offense should not be counted"" as a predicate offense in determining his status as a career offender, and warranted a corresponding reduction in his base offense level below the career offender guidelines.
