On November 13, 1965 H.K. Porter Company, Inc. (Porter) sued Goodyear Tire & Rubber Company (Goodyear) in the federal District Court for Northern Ohio, Eastern Division in Cleveland, for infringement of two of its patents on flexible mold-formed radiator hoses. The Court found that the patents were valid and infringed by Goodyear, granted an injunction against furtherinfringement, and ordered an accounting. On appeal, we affirmed in an opinion written for the Court by Judge McCree, reported in 437 F.2d 244 (6th Cir. 1971). Goodyear filed in this Court a petition for rehearing or for remand to the District Court, alleging that this Court had overlooked and misapprehended pertinent facts and law, and that Porter's presentation to the District Court and to this Court involved misrepresentation and other misconduct. We denied the petition for rehearing or for remand on April 16, 1971, and the Supreme Court denied certiorari, 404 U.S. 885, 92 S. Ct. 203, 30 L. Ed. 2d 169 (1971).
