Action in the Ramsey County District Court wherein plaintiff sought to recover for labor and materials furnished in the construction of a homestead for defendants, Victor Toushin and Zelda Toushin. Defendants counterclaimed for damages alleging that plaintiff had failed to perform its contract to erect a dwelling in accordance with certain plans and specifications, and Anchor Casualty Company was joined as third-party defendant as surety on plaintiffs performance bond. After findings for defendants, Albin S. Pearson, Judge, plaintiff and third-party defendant appealed from an order denying their motion for a new trial.
