In an action for wrongful death resulting from an automobile collision on a state highway, where the sole evidence for plaintiff consisted of certain statements made by defendants employe at the scene of the collision and his admissions later to a witness in the presence of plaintiffs attorney, both of whom were investigating the accident, the weight to be attached to such admissions was for the jury, and it was error to direct a verdict for defendants.
