The plaintiff as appellant in this court complains of a judgment rendered against him in the district court of Lea County in favor of defendant on the latters cross-complaint in an action instituted against defendant by plaintiff for damages said to have accrued by reason of alleged breaches on defendants part of an agricultural lease entered into between the parties. As a matter of fact, damages were found in plaintiffs favor by the court on certain items for which claim was made and in defendants favor on his cross-complaint in larger amount than the total awards to plaintiff. The judgment actually entered in defendants favor was arrived at by offsetting the plaintiffs judgment against the total amount awarded defendant and rendering judgment in the latters favor for the difference.
