Action commenced by plaintiff-respondent, L. L. Richards Machinery Company, a copartnership, against McNamara Motor Express,
Inc., a corporation engaged in business as an interstate common motor carrier of freight, on October 23, 1957. The action
was brought to recover damage to a used Cincinnati-Bickford super service radial drill and table. On or about September 21, 1956, the respondent purchased from the Municipal Tool and Machinery Company of St. Louis, Missouri
(shipper of the machine), 1 used 5 foot by 13 inch column Cincinnati-Bickford super service radial drill press, motor on the
arm, complete with box table and motor driven coolant system. The purchase price was $7,353.75. The L. L. Richards Machinery
Company paid $2,451.25 on account.
