Oklahoma Alcoholic Beverage Control Board v. Moss

1 The Oklahoma Alcoholic Control Board (Board) urges on appeal that the District Court in reviewing the order of the Board, erred in vacating its order in three instances: (1) by substituting its judgment as to the weight of the evidence for that of the Board; (2) in finding that the Boards order was not supported by a preponderance of the evidence, when the court should have determined whether or not the Boards order was clearly erroneous in view of the evidence submitted; and (3) in finding that the order of the Board was in excess of its statutory authority.
