[172 CalApp3d Page 880] After trial by jury, defendant was convicted of two counts of rape (Pen. Code, ? 261, subd. (2))1 and one count of burglary (? 459). The jury further found defendant used a deadly weapon, a knife, in the commission of the second rape. In a separate, bifurcated trial, the court found an alleged prior felony conviction for involuntary manslaughter (former ? 192, subd. 2) was true. The trial court sentenced defendant to a total term of imprisonment of 18 years. Defendant filed a timely notice of appeal.
