Submitted: November 4, 2005 Before STEELE, Chief Justice, BERGER and JACOBS, Justices ORDER This 24th day of January 2006, upon consideration of the briefs of the parties, it appears to the Court that the judgment of the Superior Court should be affirmed on the basis of and for the reasons set forth in its decisions dated June 1, 2005, and June 22, 2005. We, furthermore, find no error on the part of the Superior Court in not addressing the issue of the cross claim asserted by the appellant in the Court of Common Pleas, since the issue was not before the Superior Court in the appeal. NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED. This matter is hereby remanded to the Superior Court for remand, in turn, to the Court of Common Pleas for the entry of judgment against Ramunno and Madric, jointly and severally, in the amount of $2,000.
