Descripción editorial
To prevail on a defense motion for summary judgment, the plaintiff in a medical malpractice case must meet the statutorily mandated burden of proof. Because the affidavit provided by Coes expert medical witness fails to meet this standard, and because the affidavit did not affirmatively demonstrate that the expert was competent to testify to the matters therein, the trial court did not err in granting summary judgment to Dr. Wardle.
