TIMBERS, Circuit Judge: Appellant, the United States, appeals from a summary judgment entered in the Northern District of New York, David N. Hurd, Magistrate Judge, dismissing a forfeiture action and ordering return of seized currency to claimant because of the government's failure to demonstrate probable cause for seizing the currency pursuant to 21 U.S.C. § 881(a)(6) (1992).
