Defendant Kevin Ray Dellinger appeals from the sentence of thirty-three months imprisonment he received after pleading guilty to one count of bank robbery, in violation of 18 U.S.C. 2113(a) & 2. Dellinger asks this court to decide whether the district court abused its discretion in failing to grant the governments motion for a downward departure in Dellingers sentence, based on the substantial assistance he provided to authorities.
