Descripción editorial

Defendant Gary Dupaquier was convicted of possession of a firearm by a convicted felon in violation of 18 U.S.C. § 922(g)(1) (1988), using and carrying a firearm during and in relation to a drug trafficking crime in violation of 18 U.S.C. § 924(c)(1) (Supp. II 1990), and possession of an unregistered firearm in violation of 26 U.S.C. 5861(d) (1988). He now appeals his convictions and sentences on all three counts. We reverse Dupaquiers count one conviction, affirm his count two and count three convictions, vacate his sentences and remand for resentencing.
