COFFEY, Circuit Judge. The defendant, James Max Eliason, pled guilty to a conspiracy to transport stolen vehicles in interstate commerce in violation of 18 U.S.C. §§ 2312, 2313. In his plea agreement, Eliason reserved the right to appeal the district courts denial of his request for a Kastigar hearing to determine if the federal government was guilty of using immunized testimony against him. Kastigar v. United States, 406 U.S. 441, 32 L. Ed. 2d 212, 92 S. Ct. 1653 (1972). We affirm.
