As a result of a search of his person and briefcase by a United States Deputy Marshal not on official duty, evidence was discovered which led to the arrest and conviction of appellant Ronald M. Schleis for possession of cocaine with intent to distribute, in violation of 21 U.S.C. § 841(a)(1). The single issue presented on this appeal is whether the District Court erred in overruling Schleiss motion to suppress the seized evidence. We hold it did not and affirm the judgment of conviction.
