The action was commenced on November 9, 1959, by Alfred J. Grunwaldt, plaintiff, individually and as a taxpayer and representative of a class similarly situated against the State Highway Commission of Wisconsin and the city of Milwaukee and by amendment of the summons, the state of Wisconsin was made a party defendant. There was served with the summons an affidavit of discovery together with a notice and subpoena for an adverse examination of Elmer Krueger, an officer, agent and employee of the city of Milwaukee and executive secretary of the Board of Public Land Commissioners of the city of Milwaukee.
