Alfred R. Boettger v. Robert E. Miklich and Glenn A. Walp

The issue presented in this appeal is whether the Commonwealth Court properly interpreted the parameters of the "good faith defense" to a civil action as provided in section 5725(c) of the Wiretapping and Electronic Surveillance and Control Act. For the reasons that follow, we find that the Commonwealth Court improperly expanded the good faith defense in violation of the clear language of the statute, and accordingly, reverse the order and opinion of that Court.
