Descrição da editora

WIGGINS, J. -- Aloha Cary seeks to recover under a homeowners insurance policy after Arnold Bennett killed her husband Richard Cary by stabbing him with a butcher knife. Bennett was found not guilty of criminal conduct by reason of insanity. Bennetts guardian assigned to Cary all rights under a homeowners policy issued by defendant Allstate Insurance Company (Allstate). The policy excludes liability for criminal conduct committed by an insured person while insane. We hold that this exclusion does not violate any public policy of the State of Washington and affirm the summary judgment dismissing the claim against Allstate.
