Alois Von Bank v. K. R. Mayer and Others

The matter before us is a motion to dismiss the appeal of the defendants, Earl Lomis and Stanley L. Rybus, from the amended order of the district court of Scott county granting plaintiffs motion for a new trial. This is a personal injury action in which there was a verdict in favor of the defendants, Lomis and Rybus, the action having been dismissed as to the defendant, K. R. Mayer, during the course of the trial.
