This appeal arises from Darryl Lamar Bees jury conviction for murder. Following its determination of guilt, the jury sentenced Bee to 50 years imprisonment. Bee appeals his conviction in one point of error contending that the trial court abused its discretion by allowing the introduction of prior statements by the States witness, Darryl Mitchell, who refused to testify after ordered by the court to do so.
