Descrição da editora

This is a products liability case. Daryel Keen sued to recover for personal injuries he sustained when a trailer fell over onto the hostler he was driving. The trial court disregarded the jurys answers to issues that found Keen contributorily negligent and rendered judgment in Keens favor for the full amount of the jury verdict. The court of appeals reversed the trial courts judgment and rendered judgment reducing Keens damages in accordance with the contributory negligence finding. 709 S.W.2d 292. Because Keens contributory negligence constituted a failure to guard against a product defect, we reverse the judgment of the court of appeals and affirm that of the trial court.
