Action by landowners against a town to recover damages in the claimed amount of $4875 resulting from the relocation of a town road across the plaintiffs farm, including the taking of land, the taking of earth for road fill, and damages to trees, remaining land and a driveway. The towns answer admitted the taking of three acres of plaintiffs land and stated that defendant has been at all times ready and willing to pay fair compensation for such acreage. It denied plaintiffs allegation as to the value of the land taken, denied the other allegations of damage, and alleged that the plaintiffs had agreed to give the town the earth which was taken for fill, without charge.
