Gladys Merek v. S. J. Groves & Sons

A motion for new trial upon the ground of newly discovered evidence is addressed to the sound discretion of the trial court, and if such evidence is merely cumulative, contradictory, or impeaching of evidence at the trial and not likely to change the result, denial of a new trial is not an abuse of discretion.
