Descrição da editora

Mrs. Minnie Gold appeals from an order of the United States District Court for the Eastern District of New York (Jacob Mishler, Chief Judge) granting the governments motion for summary judgment and dismissing her complaint requesting that the court reverse a final decision of the Secretary of Health, Education and Welfare denying her a period of disability and disability benefits under the Social Security Act, 42 U.S.C. §§ 405(g), 416, 423. The sole issue for this court is whether the decision of the Secretary is supported by substantial evidence on the record as a whole. 42 U.S.C. § 405(g). We conclude that his decision is not so sustained and order it reversed and the case remanded for calculation of a period of disability and award of benefits to Mrs. Gold.
