Heil Co. v. Polar Corp‪.‬

Appellant The Heil Company ("Heil") challenges the trial courts order denying its motion for summary judgment and granting summary judgment in favor of appellees Polar Corporation, as the surviving entity of a merger between Pentron, Inc. ("Pentron") and Polar ("Polar"), and Richard L. Frank ("Frank"). In three issues, Heil complains that the trial court erred by denying its motion for summary judgment, by granting Polars motion for summary judgment, and by overruling its objections to part of Polars summary judgment evidence. We affirm the trial courts judgment as to Polar but reverse and remand the trial courts judgment as to Frank.
