In Re Butler

Robert P. Butler appeals the decision of the Board of Patent Appeals and Interferences ("Board") of the Patent and Trademark Office ("PTO"), which affirmed the final rejection of claims 23, 24, 26, 27, and 43-47 of Butlers patent application Serial No. 07/908,967, filed July 6, 1992, as obvious under 35 U.S.C. 103 over two prior art references. Because the Board clearly erred in finding a motivation to combine the references, we reverse.
