In Re Champion Technologies

Relators, Champion Technologies, Inc. and Permian Mud Service, Inc., filed a petition for writ of mandamus on May 27, 2005, attacking the trial courts disposition of their motion to compel arbitration. After receiving responses to the petition from the real parties in interest, this court denied the petition on July 14, 2005, without issuing a written opinion. See TEX.R.APP.P. 52.8(d). Relators subsequently filed a motion for rehearing on July 28, 2005. Upon considering the motion for rehearing and the responses filed thereto, this courts judgment denying the petition is withdrawn, and the petition is conditionally granted as set forth below.
