In Re Estate of Arthur Couch

Arthur Couch died June 13, 1984. His will was admitted to probate in Benton County. Reba L. Grady, who was not mentioned in the will, filed a petition for an order requiring the personal representative to set aside to her an intestate share of the estate on the basis she was a pretermitted heir. This petition was dismissed for failure to state a claim upon which relief could be granted. CR 12(b)(6). The propriety of this dismissal presents the sole issue on appeal.
