The opinion of the court was delivered by This appeal grows out of an ancillary administration of the estate of Charles Bertrand, a nonresident testate deceased. The probate court of Thomas County, where ancillary administration proceedings were conducted, refused to discharge the ancillary nonresident executor for failure to comply with its order of final settlement which it construed as requiring such executor to pay his Kansas attorneys the fees allowed for their services.
