Case, for negligence, to recover the amount paid by the plaintiff in interest as compensation under the workmens compensation act to one Tessier, a servant of the plaintiff McCullough, for personal injuries received by said servant while in his employ and alleged to have been caused by the negligence of the defendant. Trial by jury. At the close of the plaintiffs evidence the defendants motion for a nonsuit was granted and the plaintiff excepted. The plaintiffs bill of exceptions was allowed by Lorimer, J.
