This is an appeal from a conviction for the misdemeanor offense of driving a motor vehicle on a public highway while intoxicated. A jury assessed the appellants punishment at confinement in the county jail for one year and a fine of two hundred dollars. The trial court granted the appellants motion for probation and placed him on probation for one year. The appellants principal contention is that the evidence is insufficient to support the conviction because the evidence does not show that the appellant drove a motor vehicle on a public highway, and, if he did, the evidence does not show that it was while he was intoxicated.
