There is no evidence whatever to prove, or tending to prove, that 'James Smith, blacksmith,' of Cape Girardeau, ever lived in the village of Little Prairie, or even in the county of New Madrid, or that he ever owned any land there. The necessary conclusion is that he fraudulently personated the real J. Smith.
