Mancuso V. United Bank Of Pueblo

We granted certiorari to consider whether the Colorado Court of Appeals erred when it affirmed the trial court's order of summary judgment in Mancuso v. United Bank of Pueblo, 796 P.2d 7 (Colo. App. 1990). The trial court held that, as a matter of law, petitioner's funds at United Bank were not special deposits, and petitioner's accounts at United Bank were not subject to either a constructive trust or a resulting trust. We affirm the court of appeals' conclusion with respect to the first issue, reverse the court of appeals' judgment with respect to the second issue, and remand to the court of appeals with instructions to return the matter to the trial court for further proceedings consistent with this opinion.*fn1
