Descrição da editora

Lee Andrew Campbell appeals his conviction of possessing cocaine with intent to distribute in violation of 21 U.S.C. § 841(a)(1) (1982). The sole issue on appeal is whether Campbell was unlawfully seized in violation of the fourth amendment before he consented to a search of his coat which revealed cocaine in its pocket. The district court, adopting the recommendations of the magistrate, concluded that Campbell was lawfully seized based on reasonable and articulable suspicion of criminal activity under the principles of Terry v. Ohio, 392 U.S. 1, 20 L. Ed. 2d 889, 88 S. Ct. 1868, (1968), and that he voluntarily consented to the search of his coat. We affirm the conviction.
