Order On order of the Court, the delayed application for leave to appeal is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the Montcalm Circuit Court's November 1, 1991 order denying the defendant's request for the appointment of appellate counsel and REMAND this matter to the circuit court with the direction that the court shall grant the defendant's October 15, 1991 request and appoint appellate counsel to represent him. Contemporaneously with the entry of the order of appointment, the circuit court shall call the appointed lawyer's attention to the provisions of MCR 7.205(F)(4). We do not retain jurisdiction.
