[T][U] Delta Life And Annuity Co. V. Freeman Financial Services Corp‪.‬

Appellant, Delta Life and Annuity Company, filed an action in federal district court alleging appellees violation of federal antitrust law and RICO. Delta also alleged violation of several state statutes. The district court dismissed all of Deltas claims pursuant to a motion under Federal Rule of Civil Procedure 12(b)(6). We conclude that because a state court in a parallel action has issued a final judgment, the doctrine of res judicata prevents us from examining the RICO and state law claims. We also affirm the district courts dismissal of the Sherman Act claim as barred by the McCarran-Ferguson Act.
