Bryan Gooch appeals an order on RALJ appeal affirming his municipal court conviction for assault. He contends that the prosecutors statements at the outset of trial narrowed the charge and/or the evidence to an assault by means of a threat, and that his subsequent conviction for an assault by striking or touching must therefore be reversed. He also contends there was insufficient evidence to support his conviction. We affirm.
