The opinion of the court was delivered by This is an action by plaintiff, Unified School District No.
255, to recover equitable payment from defendant, Unified School
District No. 254, under the provisions of K.S.A. 1965 Supp.
72-6776 [now K.S.A. 1968 Supp.]. The action stems from the
division and disorganization of Rural High School District No. 7,
Barber County, by the unification of Barber County on July 1,
1966, into two unified districts which are the parties to this
action. There were some deviations from the county line between
Barber and Pratt counties which are immaterial to the issues
herein. The underlying issues on appeal concern the constitutionality
of 72-6776 and its application to the facts of the case.
