Descrição da editora

Per Curiam: Plaintiff-Appellee's petition for rehearing discloses that defendant-appellant did not make a motion for judgment notwithstanding the verdict. Such being the case, this Court is limited, upon reversal, to the granting of a new trial. Cone v. West Virginia Pulp & Paper Co., 330 U.S. 212, 91 L. Ed. 849; Johnson v. New York, New Haven & Hartford Ry. Co., 344 U.S. 48, 97 L. Ed. 77. Finding error in the district judge's denial of defendant's motion for directed verdict, made at close of proofs, we reversed with direction to enter judgment for defendant.
