Pursuant to Hawai'i Rules of Appellate Procedure (HRAP) Rule 40(a) and (b), Defendant-Appellant Stephen M. Shaw filed a Motion for Reconsideration on January 16, 1996. Upon consideration of Defendant-Appellant's motion for reconsideration filed on January 16, 1996, and the record herein, IT IS HEREBY ORDERED that Defendant-Appellant's motion for reconsideration is granted pursuant to HRAP Rule 40(d); and IT IS FURTHER ORDERED that pursuant to HRAP Rule 40(c), Plaintiff-Appellee Bank of Hawaii shall file an answer to the aforementioned motion for reconsideration no later than February 5, 1996.
