Beaver V. Estate Of Urban Harris

Plaintiff (respondent) brought this action against Urban Harris and Marjorie Harris, his wife, for personal injuries received in an automobile accident. Urban Harris has since died and his estate substituted as defendant. For convenience, we will refer to the parties as plaintiff and defendant. The defendant answered and alleged contributory negligence and, as a second affirmative defense, a settlement contract with the plaintiff wherein the plaintiff received $1,750 for a full, complete and final release
