Bennett v. Schweiker

Per Curiam. Appellant Ethel B. Bennett is seeking disability insurance benefits and supplemental security income benefits under Title II and XVI of The Social Security Act, 42 U.S.C. §§ 416(i), 423(d), and 1382c(a)(3). Mrs. Bennett claims to have been disabled by abdominal and low back pain from April 1, 1978 through December 31, 1980. Mrs. Bennetts claim was originally denied by the Secretary of Health and Human Services (the Secretary) and remanded on appeal by the District Court for further administrative proceedings. On remand, the Administrative Law Judge (ALJ) held an additional hearing to determine whether Mrs. Bennett was disabled by pain, and again recommended that the claim be denied. The Appeals Council adopted this opinion with some modifications, and the District Court affirmed the opinion as modified. We now affirm the opinion of the District Court.
