State Department of Revenue v. Medical Care Equipment Inc‪.‬

NationsBanc Investments, Inc., and Robert Lipscomb, defendants in an action pending in the Tuscaloosa Circuit Court, appeal that courts order denying their motions to dismiss or, in the alternative, to stay proceedings and to compel arbitration of the plaintiffs claims. For the reasons outlined below, we reverse and remand with instructions.
