State Texas v. Jim Erwin Thomas

A jury convicted appellee of aggravated sexual assault and assessed punishment at fifty years confinement in the Texas Department of Corrections. The trial court granted appellee a new trial on the grounds that appellees trial counsel was ineffective. Proceeding under article 44.01 of the Texas Code of Criminal Procedure Annotated (Vernon Supp. 1989) the State contends the trial court abused its discretion in granting the motion for new trial. We affirm.
