A jury found appellant, Victor Koadinita Utomi, guilty of the offense of possession of a controlled substance in an amount over four grams and less than 200 grams with intent to deliver. The indictment included enhancement paragraphs for two prior felony convictions. After finding both enhancement paragraphs true, the trial court assessed appellants punishment at 40 years confinement. In three issues, appellant argues that (1) the evidence is legally and factually insufficient to prove that he (a) possessed cocaine (b) with the intent to deliver and (2) the trial court committed reversible error by making an improper comment during voir dire.
