This is the appellants appeal from a second trial for the murder of Lisa Wilber. The appellant was tried first in 1985 in Hardin County. The Hardin County jury found the appellant guilty of murder and assessed punishment at 55 years. The Ninth Court of Appeals in Beaumont reversed the conviction, finding the trial court erred in denying the motion for a new trial based upon newly-discovered evidence. Long v. State, 739 S.W.2d 98 (Tex.App.-- Beaumont 1987, pet.refd). In 1988, on a change of venue, the appellant was retried in Galveston County. The Galveston County jury also convicted the appellant of murder and assessed punishment at 60 years.
