Appellant was indicted on January 11, 1982, for the then third-degree felony offense of delivery of more than one-fourth ounce of marijuana. See Art. 4476-15, ? 4.05 of the Texas Controlled Substances Act. Upon appellants plea of guilty, the trial court deferred further proceedings in the cause, without entering an adjudication of guilt, and entered an order on April 23, 1982, placing appellant on deferred adjudication probation for five years, pursuant to Art. 42.12, ? 3d(a), V.A.C.C.P. On August 4, 1988, well after the probationary period had expired, the trial court proceeded to an adjudication of guilt and sentenced appellant to a term of five years in the Texas Department of Corrections.
